Private Wealth Planning

Founded in 1926 with a trust and estates practice, Best & Flanagan is dedicated to working in a personal and customized way with each client, most of whom are high net worth individuals and families. Our Private Wealth Planning attorneys are seasoned counsel who value discretion and the close relationships we have with our clients and their families. In recent years, Best & Flanagan has become a leading firm in resolving fiduciary disputes, with significant experience as estate planners and litigators. Our clients appreciate that we offer pragmatic solutions, particularly when dealing with major and complex estates. Our work, like our clients, is often sophisticated, and includes:

  • Wills and trusts
  • Wealth preservation through gift and estate tax planning
  • Family and closely held business succession planning
  • Trust and estate litigation
  • Gifting
  • IRS Audits
  • Charitable gifts
  • Private foundations
  • Estate, fiduciary and trust income tax returns
  • Planning for liabilities
  • Conservator and guardianship matters

We strive to minimize the tax burden imposed on our client’s estate or trust. We design and administer revocable and irrevocable trusts, grantor trusts, life insurance trusts, split-interest (charitable) trusts and durable powers of attorney. We prepare business shareholder agreements and other types of arrangements for owners with estates that contain closely-held business interests.

We consistently provide outstanding representation in contested and uncontested probate, trust and conservatorship proceedings. We advise fiduciaries in state and federal courts, and handle probate matters such as will contests, petitions for distribution, as well as petitions to determine the distribution of estates and trusts.

We prepare and review intricate estate and gift tax returns, as well as assist with tax audits and private letter rulings. We also represent fiduciaries and beneficiaries in court proceedings when and if an obstacle cannot be overcome during the audit process. We have resolved estate-related disputes involving fee controversies, ownership and creditor problems, breach of trust and will and trust contests.
