Government Law & Land Development: Condemnation & Eminent Domain

Best & Flanagan provides the depth and breadth of expertise stemming from decades of measurable results in eminent domain law. Our clients benefit from the firm’s collective knowledge and experience gained from representing corporate and individual landowners, as well as local and regional government. Our attorneys maintain practical experience handling complex issues of highest and best use, severance damages, contaminated property, allocation of landlord/tenant damages, taking of access, construction interference and loss of going concern from the perspective of both landowner’s counsel and of government counsel.

We are zealous advocates in obtaining just compensation for landowners whose property is taken by the government for a public purpose. We have represented landowners involved in a wide range of property, including industrial, retail, office, condominium, multifamily residential, single family residential, agricultural and vacant land held for development. When working with our clients, we take a cooperative and results driven approach with appraisers (property and fixture), condemnation commissioners and urban planners in order to obtain the highest value possible for the property.

We also have experience in acquiring property for government clients by negotiated purchase and by eminent domain for public improvements including streets, parks, utilities, building sites, transit and redevelopment projects. Our lawyers have handled condemnation matters for the cities of Golden Valley, Minnetrista, Orono, Wayzata and the Minneapolis Park and Recreation Board, as well as served as special condemnation counsel for the Metropolitan Council.
